These Terms of Service ("Terms") govern your use of cyberinsurancecalc.com and any associated tools or services ("Site") operated by Cyber Insurance Calculator, part of the CISO Marketplace partner network.

1. Nature of the Service

The Cyber Insurance Calculator is a free educational and lead generation tool. It is designed to help businesses understand their cyber security posture and approximate cyber insurance needs. It is not:

• An insurance company, broker, agent, or underwriter
• A licensed insurance advisor or financial advisor
• A source of binding insurance quotes
• Legal, compliance, or regulatory advice
• A substitute for a professional cyber security assessment

Use of this tool is purely for informational and self-assessment purposes. Always consult a licensed insurance professional before making coverage decisions.

2. No Insurance Advice — Important Disclaimer

• Actual premiums are determined by insurance carriers through their own underwriting process and may differ substantially from our estimates
• Coverage eligibility, exclusions, sublimits, and terms vary by carrier and policy — review all policy documents carefully
• Our risk score is not an actuarial assessment and does not reflect a carrier's own risk evaluation of your organization
• We make no warranty that completing this assessment will result in obtaining insurance coverage
• Regulatory and legal requirements vary by jurisdiction — consult qualified counsel for compliance advice

3. Affiliate & Referral Disclosure

This Site contains links to insurance carriers (AIG, Chubb, Travelers, Beazley, Hiscox, Coalition, At-Bay) and other third parties. We may receive referral fees, commissions, or other compensation when:

• You click a carrier link and subsequently purchase a policy
• We provide your lead data to a carrier or broker and an introduction results in a bound policy
• You access a partner service (ir.breached.company, ircost.breached.company, ciso.diy, cyberpolicy.shop, cisomarketplace.services) through our partner network links

This compensation does not influence the order, scoring, or recommendations we make. Our risk scores and carrier matching are based solely on your assessment responses and our scoring methodology, not on carrier relationships. All carrier recommendations are our genuine assessment of appropriate coverage for your risk profile.

Carrier links include UTM tracking parameters (utm_source=cyberinsurancecalc) solely to measure referral volume for commission reporting purposes. These parameters do not transmit your personal information to carriers.

4. Data Collection & Lead Sharing

By using this Site and providing your email address, you consent to:

• Storage of your contact email and organization profile in our database, and of anonymized assessment analytics (no personal identifiers)
• Receipt of your personalized Cyber Insurance Readiness Report via email
• Receipt of relevant cyber insurance updates and product communications (with opt-out in every email)
• Your contact information and assessment context being used to facilitate introductions to licensed insurance carriers and brokers for quoting purposes

5. Permitted Use

You may use this Site to:

• Assess your organization's cyber security posture for your own internal purposes
• Use the results to prepare for conversations with insurance carriers and brokers
• Share your results report with colleagues, advisors, or insurance professionals
• As a licensed insurance broker or MSSP: run assessments for your clients (provided you disclose to clients that this is a third-party estimation tool)

You may not use this Site to:

• Scrape, copy, or redistribute our assessment questions, scoring methodology, or content at scale
• Submit false, misleading, or fraudulent organization information
• Use automated scripts or bots to complete assessments
• Represent our estimates as official insurance quotes to third parties
• Build a competing product by copying our assessment structure or scoring logic without permission
• Use the Site in any unlawful manner or in violation of applicable regulations

6. Intellectual Property

The assessment questions, scoring methodology, recommendation library, and content on this Site are proprietary to Cyber Insurance Calculator. The underlying application code is available under the MIT License on GitHub. You may not reproduce, sell, or sublicense our proprietary content without written permission. Carrier names, logos, and trademarks are the property of their respective owners and are referenced here for identification purposes only.

7. Limitation of Liability

Some jurisdictions do not permit limitation of liability for certain types of damages. In such cases, our liability is limited to the minimum amount permitted by law.

8. Third-Party Links & Services

Links to carrier websites, partner tools, and other external resources are provided for convenience. We do not control, endorse, or assume responsibility for third-party websites or their content, privacy practices, or services. Your use of third-party sites is at your own risk and subject to their own terms.

9. Advertising

The Site displays sponsored content and advertisements served through CyberAdX, a B2B cybersecurity advertising network, and may include other programmatic advertising partners listed in our ads.txt file. Sponsored content is labeled as such. We do not endorse advertised products or services.

10. Governing Law & Disputes

These Terms are governed by the laws of the United States. Any disputes arising from your use of the Site will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm. You waive your right to participate in class action proceedings.

11. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top indicates when changes were made. Continued use of the Site after changes constitutes acceptance of the revised Terms.
